Separation of Marriage and State

CBC News on Ottawa to recognize same-sex marriages:

Ottawa will introduce legislation to make same-sex marriages legal, while at the same time permitting churches and other religious groups to "sanctify marriage as they see it," the prime minister said Tuesday.

Jean Chr‚tien made the announcement after a day-long cabinet retreat. It means Ottawa will not appeal two provincial court rulings allowing same-sex unions.

Of course the libertarian argument, which I agree with, is that governments shouldn't be involved with marriages in any way, shape or form. No government should be issuing licenses or defining what a makes a marriage. (Religious Right, Senator Santorum – I'm talking to you.) But – so long as states continue to poke their noses in this realm, I see nothing wrong with making same-sex marriages legal.

In fact, to do otherwise establishes a government enforced discriminatory policy which is in direct violation of my libertarian belief in individual rights. And I really don't care to hear anyone's religious dogma regarding why the state should discriminate in such a manner. It is irrelevant and based on theocratic mandates, not individual liberty. If you don't want to perfom same-sex marriages in your house of worship, then don't. But to insist that government do your religious dirty work is an overt promotion of theocracy. We can't have that in a 'free' society.

Update: That Balko guy, some Reason reporter and a Peoria Pundit said something similar.
